1. Acceptance of Terms

By accessing or using Roost ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Roost is a smart home management platform that helps households organize their home, automate routines, track devices, manage maintenance, and coordinate with household members. The Service may include features such as automation scheduling, recipe management, maintenance tracking, and integrations with third-party smart home devices and services.

3. Accounts

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this age requirement.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Transmit any material that is harmful, offensive, or otherwise objectionable
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to the Service or its related systems or networks
  • Use the Service in any manner that could damage, disable, or overburden Roost's infrastructure

5. Subscriptions and Billing

Roost offers both free and paid subscription plans. By selecting a paid plan, you agree to pay the applicable fees. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as expressly stated in these Terms.

We reserve the right to change our pricing at any time. If we change the price of your subscription, we will provide at least 30 days' notice before the change takes effect. Your continued use of the Service after the price change constitutes your agreement to pay the new price.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Roost and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Roost.

You retain ownership of any content you submit to the Service. By submitting content, you grant Roost a worldwide, non-exclusive, royalty-free license to use, reproduce, and display that content solely for the purpose of providing the Service to you.

7. Third-Party Services

The Service may integrate with or contain links to third-party websites, applications, or services. Roost has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party services. We encourage you to review the terms and privacy policies of any third-party services you connect to Roost.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Roost does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Roost and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if Roost has been advised of the possibility of such damages. In no event shall Roost's total liability exceed the amount you paid to Roost in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through your account settings.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "last updated" date at the top of this page and, where appropriate, by sending you an email. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.
